Re-examination of the Prohibition of Sinfulness's Viewpoint in Imām Jamā'at with Emphasis on Traditions

Abstract

One of the most important issues that are discussed in various jurisprudential subjects such as taqlīd, shahādāt, jamā‘at, etc is the issue of justice which there is an extended dispute between scholars regarding it's definition but there is no significant dispute about its different cases in jurisprudence. One of these cases is about the leader of the congregation imām al- jamā‘at, which was disputed whether justice is required for it or only transgression is an obstacle. The result of this dispute is revealed in the case of an unknown person in such a way that according to the first point of view iqtidā it is not permissible while according to the second basis it is possible to allow it. In this article, the writer seeks to determine which of these views about Imam of Jamaat has sufficient evidence in jurisprudential sources. This research, which was carried out in a descriptive and analytical method and using library data, indicates that in the verses and traditions, not only there is no evidence for the requirement of justice regarding the imam of the congregation, but also many authentic traditions that are usually neglected clearly indicate the view of the prohibition of transgression.
