This law maintains the following concerning how to pay for the diya (blood money) mentioned under article 468, “‘Āqila includes father, son, and the paternal and maternal blood relatives or paternal in order of inheritance level.” The content of the latter article relies on the consent of the renowned majority of the Imāmī jurists. They believe, “With the existence of the nearest of kin, undertaking of the farthest of kin is inapplicable and in case of the presence of all the male blood relatives, payment of the blood money is obligatory upon the nearest of kin according to the level of inheritance.” Their main evidence is their relying on the āya, ﴾but the blood relatives are more entitled to inherit from one another in the Book of Allah﴿ as well as the traditions concerning the above-mentioned issue. The writer does not regard as complete the reliance on the above āya and as fully approved the reliance on traditions. After criticizing the evidences of the generally accepted view, he concludes the following, “In payment of the blood money for unintentional homicide, the observance of order among the āqilia is not necessary and all of them are responsible for payment of the blood money; even though they are not heritable at death.” Although contrary to the generally accepted view, this view has drawn the agreement of some of the jurists; moreover, the generalities of the evidences approve it as well.”}, keywords = {unintentional homicide,āqila (blood relatives),division of blood money,generally accepted view,article 468 of Islamic Penal Law}, title_fa = {تأمّلی در مستندات فقهی ماده 468 قانون مجازات اسلامی مصوّب 1392}, abstract_fa = {قانون مجازات اسلامی مصوّب 1/2/1392 با پذیرش مسئولیت عاقله در قتل های خطایی این نظریه را در ماده-ی 463 منعکس نموده است. این قانون درباره نحوه پرداخت دیه ی مذکور ذیل ماده 468 چنین مقرر نموده است: «عاقله عبارت از پدر، پسر، و بستگان نسبی پدری و مادری، یا پدری به ترتیب طبقات ارث است». مفاد ماده ی اخیر مستظهر به موافقت مشهور فقهای امامیه می باشد. ایشان معتقدند: «با وجود عاقله ی اَقرَب، عُهده ی عاقله ی اَبعَد مشغول نمی باشد و در فرض اجتماع خویشاوندان ذکور نسبی(= عاقله) تأدیه ی خون بهاء و پرداخت دیه بر ذمّه ی نزدیک ترین اقارب به حسب طبقات ارث می باشد».مستند عمده ی ایشان استظهار از آیه «وَأُولُواالْأَرْحامِ بَعْضُهُمْ أَوْلى بِبَعْضٍ» و نیز روایات ناظر به مسأله ی پیشگفته می باشد. نگارنده استظهار از آیه ی فوق را تمام نمی داند و استدلال به آن روایات را تام نمی یابد. وی پس از نقد مستندات قول مشهور چنین نتیجه می گیرد که: «در پرداخت دیه ی قتل خطایی، رعایت ترتیب بین عاقله لازم نبوده و همگی ایشان مسئول پرداخت دیه هستند؛ اگرچه حین الفوت ارث بر نباشند». این نظریه اگرچه خلاف قول مشهور است؛ لیکن برخی از فقهاء را با خود موافق نموده است؛ مضافاً به این که اطلاقات و عمومات ادلّه نیز آن را اقتضاء دارد.}, keywords_fa = {قتل خطایی,عاقله,توزیع دیه,قول مشهور,ماده 468 ق.م.ا}, url = {https://jfiqh.um.ac.ir/article_29346.html}, eprint = {https://jfiqh.um.ac.ir/article_29346_57c3b074fd50b20d696658b82e7e40f3.pdf} }
