Some jurists have claimed that the sentence is confined to the two latter options and considered muslimization as the only way to release the prisoner. Such opinions have become the pretext of Takfiri groups and the basis of anti-Islamic propaganda. This paper which has been organized through a descriptive-analytical method and library tools has criticized and analyzed the arguments of jurists in this regard by studying the Shiite and Sunni jurisprudential, hadithi and interpretation texts and historical sources. The purpose of this research is to explain accurately and wisely the sentence of the prisoner of war in Islam based on jurisprudential sources and jurisprudential reasoning method in order to respond scientifically the baseless perceptions and the Islamophobia attack from this aspect. The results of this research show that the sentence of the prisoner of war is limited to its two Quranic options of Mann and Fedaa; the sentence of killing is specific to those who have committed a specific crime and slavery, if proven, has been a temporary sentence in the early Islam due to the special circumstances of that time.}, keywords = {prisoner of war,killing and slavery of the prisoner of war,Mann and Fedaa}, title_fa = {تحلیل انتقادی دلایل فقیهان بر «قتل»، «بردگی»، «منّ» و «فداء» اسیر جنگی}, abstract_fa = {با آنکه قرآن کریم حکم اسیر جنگی را منحصر به دو گزینه «منّ» و «فداء» (آزاد کردن بدون عوض و با عوض) دانسته است، بسیاری از فقیهان، حکم «قتل» و «بردگی» را نیز بدان افزوده‌اند. برخی نیز مدعی انحصار حکم در دو گزینه اخیر شده و فقط «مسلمان شدن» را راه آزادی اسیر برشمرده‌اند. این گونه نظرها، دستاویز گروه‌های تکفیری و دستمایه تبلیغات ضد اسلامی شده است. این نوشتار که به شیوه توصیفی- تحلیلی و روش کتابخانه‌ای سامان یافته، با مطالعه متون فقهی، حدیثی و تفسیری شیعه و اهل‌سنت و منابع تاریخی، به نقد و بررسی دلایل فقیهان دراین‌باره پرداخته است. هدف از تحقیق، تبیین دقیق و عالمانه حکم اسیر جنگی در اسلام، مبتنی بر منابع و روش استدلال فقهی است تا به برداشت‌های نااستوار و هجمه اسلام‌هراسی از این زاویه، پاسخ علمی دهد. نتایج تحقیق نشان می‌دهد که حکم اسیر جنگی منحصر به دو گزینه قرآنی آن (منّ و فداء) است؛ حکم قتل ویژه افرادی است که مرتکب جرمی خاص شده‌اند، و بردگی اسیر نیز به فرض اثبات، حکمی موقتی در صدر اسلام به سبب شرایط ویژه آن برهه بوده است.}, keywords_fa = {اسیر جنگی,قتل و بردگی اسیر,منّ و فداء}, url = {https://jfiqh.um.ac.ir/article_33650.html}, eprint = {https://jfiqh.um.ac.ir/article_33650_b0ce95d5e4bfd6c59e3476a92000064f.pdf} }
