There are precepts in the Islamic jurisprudence including prescribed punishments whose execution by ordinary people, at first sight, appears to be permitted while if they fall within the competence of the public, this leads to chaos in the society and is, apparently, against public order. The present paper, through case studies on a number of such precepts, seeks to answer the question whether assigning them to the public contradicts the public order or not. The conclusion is that such precepts were issued at a time when the Islamic state was not established and the individual jurisprudence prevailed and private interests were preferred over public interests. However, in situations the righteous Islamic state is established and the social and political jurisprudence prevails, the precepts of the governmental jurisprudence are given priority over the above said precepts. Some precepts which contradict the public order and have been issued due to necessity are restricted to exigent circumstances.  Proving the point that whenever the great jurists have mentioned order they have intended public order is also an achievement of this research which has been performed using library tools and through descriptive-analytical method.}, keywords = {public order,contradiction with public order,precepts contradicting the public order,governmental jurisprudence,the ruler’s authorization}, title_fa = {بررسی احکام مغایر نظم عمومی در فقه}, abstract_fa = {اجرای احکام شرعی و تصدی امور مهم و عمومی جزء وظایف حاکم شرع یا مجتهد جامع‌الشرایط است و اقدام خودسرانه و بدون اذن حاکم شرع آحاد جامعه در این امور پسندیده نیست. احکامی چون حدود در فقه وجود دارد که در بدو امر به نظر می‌رسد اجرای آن‌ها برای مردم عادی جایز شمرده شده، درحالی‌که در حیطه عمل عموم قرار گرفتن آن‌ها به هرج‌ومرج در جامعه انجامیده و ظاهراً مغایر نظم عمومی است. این نوشتار با بررسی مصداقی شماری از این احکام در پی پاسخ‌گویی به این سؤال است که آیا سپردن آن‌ها به دست عموم با نظم عمومی مغایرت دارد یا خیر. نتیجه به دست آمده اینکه این قبیل احکام در ظرف  عدم استقرار حکومت اسلامی و سیطره فقه فردی و  ترجیح مصالح شخصی بر مصالح عمومی، صادر شده است. اما در شرایط استقرار حکومت صالح اسلامی و سیطره فقه اجتماعی و سیاسی، در برابر احکام حکومتی محکوم است. برخی از احکام مغایر نظم عمومی نیز از باب اضطرار صادر شده و مقید به شرایط اضطرار است. اثبات این نکته که هرجا فقهای عظام، جز برخی معاصران، از «نظام» یاد کرده‌اند مقصودشان نظم عمومی است نیز از دستاوردهای این پژوهش است که به‌صورت کتابخانه‌ای و به روش توصیفی تحلیلی‌ تدوین شده است.}, keywords_fa = {نظم عمومی,مغایرت با نظم عمومی,احکام مغایر نظم عمومی,فقه حکومتی,اذن حاکم}, url = {https://jfiqh.um.ac.ir/article_33998.html}, eprint = {https://jfiqh.um.ac.ir/article_33998_5b9d5d964d8fe39878be6c60d88728f0.pdf} }
