On the opposite of apparent motive, if something is considered as real motive, it will be generalizer and restrictor of precept. In this paper, the authors have attempted to discover the basis of this classification, the concept and the similar and different characteristics of apparent motive and real motive. It appears that the jurist has mental background due to the famous fatwa, specific hadiths and the spirit of caution in the classification of ratiocinations into real motive and apparent motive.  }, keywords = {Apparent motive of a precept,real motive of a precept,the ratiocinated precepts,ratiocination of precepts}, title_fa = {واکاوی و تبیین جایگاه مصطلحات علت و حکمت در استنباط احکام}, abstract_fa = {برخی از روایات و آیات دربردارنده احکام، معلَّل به تعلیلاتی هستند که فقها آن‌ها را با دو نامگذاری حکمت و علت تقسیم کزده‌اند. چنانچه چیزی علت قلمداد شود، برخلاف حکمت، معمِّم و مخصِّص حکم خواهد بود. در این مقاله سعی بر آن است اساس این تقسیم‌بندی، مفهوم و ویژگی‌های متفاوت و متشابه حکمت از علت باز شناخته شود. ظاهر امر، نشان‌دهندۀ سبق ذهنی فقیه به‌جهت شهرت فتوا، روایات خاص و همچنین روحیۀ احتیاط در تقسیم تعلیلات به علت و حکمت است.}, keywords_fa = {حکمت حکم,علت حکم,احکام معلل,تعلیل احکام}, url = {https://jfiqh.um.ac.ir/article_34009.html}, eprint = {https://jfiqh.um.ac.ir/article_34009_70a26d004f53c9d6aaf3cfb63261fbdd.pdf} }
