The essential question is whether the violation of these laws, in addition to committing a crime, amounts to the occurrence of a sin, so that in addition to the worldly punishment, the afterlife punishment awaits the perpetrator, or there is no connection between crime and sin. In response to this question, the Islamic thinkers have offered different views: some have denied the connection between crime and sin; another group maintain that violation of Islamic state laws constantly correlates with the occurrence of sin before Allah; the third group have limited the realization of the two titles to the absence of conflict with Sharia rules and another group have not completely denied the correlation between the laws and the Sharia rules and in case Islamic government decrees are violated, have accepted the occurrence of crime and sin in certain cases. In this research, by criticizing and examining different opinions, the real relationship between crime and haram (forbidden) has been explored and by explaining the correct point of view, an appropriate step has been taken in response to this question. }, keywords = {Crime,Forbidding,Government Decrees,Sharia,law}, title_fa = {بازپژوهی تطبیق عنوان گناه بر عمل مجرمانه در حکومت دینی}, abstract_fa = {یکی از اهداف مهم تشکیل حکومت اسلامی، اجرای احکام شریعت در جامعه شمرده شده است. قانونگذار نیز باتوجه‌به نیازهای مادی و معنوی اجتماع به وضع قوانین و مقررات اقدام می‌کند تا از این طریق، امنیت جامعه و حقوق اقشار مختلف را به بهترین شکل تأمین کند. سؤال اساسی این است که آیا تخلف از این قوانین افزون بر ارتکاب جرم، وقوع گناه را به دنبال دارد، به‌طوری‌که علاوه بر مجازات دنیوی، مجازات اخروی هم در انتظار مرتکب باشد یا بین جرم و گناه ارتباطی وجود ندارد؟ متفکران اسلامی در پاسخ به این مسئله دیدگاه‌های متفاوتی ارائه کرده‌اند: بعضی ارتباط بین جرم و گناه را انکار کرده‌اند؛ عده‌ای تخلف از قوانین حکومت اسلامی را همواره ملازم با تحقق گناه در پیشگاه الهی دانسته‌اند؛ گروه سوم تحقق دو عنوان را محدود به عدم تعارض با احکام شریعت دانسته‌اند و گروه دیگر ملازمۀ بین قوانین و احکام شریعت را به‌طورکلی نفی نکرده و در صورت تخلف از احکام حکومتی، وقوع جرم و گناه را در برخی موارد پذیرفته‌اند. در این پژوهش با نقد و بررسی آرای مختلف، رابطۀ حقیقی جرم و حرام کشف شده و با تبیین دیدگاه صحیح، قدمی مناسب در پاسخ به این مسئله برداشته شده است. }, keywords_fa = {جرم,تحریم,احکام حکومتی,شریعت,قانون}, url = {https://jfiqh.um.ac.ir/article_35331.html}, eprint = {https://jfiqh.um.ac.ir/article_35331_fa8609c0c85e49b72c34be584ec90058.pdf} }
