However, in some cases, the legislator has provided for them in criminal codes taking into account certain considerations and in order to modify the general principles and rules of penal law. The Dar Rule (avoiding corruptions takes priority over gaining benefits), is one of the important and applied rules in the area of jurisprudence and law. This rule has been provided for in articles 120 and 121 of the Islamic Penal Code of 2013 for the first time. The contents of these articles indicate that the legislator has adopted a new approach towards this rule in the above said act which is in contradiction with the general principles and rules of penal law.In this paper, besides elaborating on whether providing for general principles and rules of penal law in criminal codes is necessary, the reason why the Dar Rule has been provided for in the Islamic Penal Code of 2013 and its contradiction with  the general principles and rules of criminal law have been analyzed and subsequently, in addition to criticizing and evaluating the new signification of the Dar Rule in the above said Code, the way court decisions deal with this rule has been taken into account.}, keywords = {the Dar Rule,Dubiety,General Principles of Penal Law,General rules of law}, title_fa = {ضرورت یا عدم ضرورت پیش‌بینی اصول و قواعد کلی حقوق کیفری در قوانین جزایی (مطالعۀ موردی قاعدۀ درأ در قانون مجازات اسلامی 1392)}, abstract_fa = {سیاست‌گذاران کیفری، اصول و قواعد کلی حقوق کیفری همچون اصل قانونی‌بودن جرم و مجازات، اصل شخصی‌بودن مجازات و قاعدۀ تفسیر به نفع متهم را در قوانین جزایی پیش‌بینی نمی‌کنند؛ زیرا مفاد و مبانی این اصول و قواعد به طور پیشینی شناسایی و به رسمیت شناخته شده‌ است. با وجود این، در برخی موارد قانونگذار با درنظرگرفتن ملاحظاتی و در راستای تعدیل اصول و قواعد کلی حقوق کیفری، آن‌ها را در قوانین جزایی پیش‌بینی کرده است.قاعدۀ درأ ازجمله قواعد فقهی مهم و کاربردی در قلمروِ فقه و حقوق است. این قاعده برای نخستین‌بار در قانون مجازات اسلامی مصوب 1392 در مواد 120 و 121 پیش‌بینی شده است. مفاد این مواد، گویای این مطلب است که قانونگذار در قانون مذکور رویکرد جدیدی نسبت به این قاعده اتخاذ کرده که با اصول و قواعد کلی حقوق کیفری در تعارض است.در این نوشتار ضمن تبیین ضرورت یا عدم ضرورت پیش‌بینی اصول و قواعد کلی حقوق کیفری در قوانین جزایی، چرایی ضرورت پیش‌بینی قاعدۀ درأ در قانون مجازات اسلامی مصوب 1392 و تعارض این قاعده با اصول و قواعد کلی کیفری، تحلیل شده و سپس ضمن نقد و ارزیابی دلالت جدید قاعدۀ درأ در قانون مذکور، به شیوۀ نگرش آرای محاکم به این قاعده نیز توجه شده است.}, keywords_fa = {قاعدۀ درأ,شبهه,اصول کلی حقوق کیفری,قواعد کلی حقوق}, url = {https://jfiqh.um.ac.ir/article_39140.html}, eprint = {https://jfiqh.um.ac.ir/article_39140_3583e200090c7c1fb3485f696d2c0faf.pdf} }
