Abstract

Custom means the common thing between people and the definite habit among them, and it is considered one of the most important concepts of jurisprudence and principles. One of the most important topics about custom is how it is manifested. Before this, various ways such as conscientious analysis, counting elements, induction, narration, and testimony have been suggested to manifest customs. This research aims to introduce one of the branches of statistics called inferential statistics as one of the tools for the manifestation of customs. Based on the statistical sample, inferential statistics using probabilities and clear logic generalize features to the entire collection. Inferential statistics can show with estimation theory or statistical hypothesis test whether the desired hypothesis is true in society with a high percentage of confidence. With its low error, inferential statistics can leave the circle of doubt and help the jurist or the obligee to the extent of certainty regarding the correct expression of the customary opinion about a matter, or at least question the decision caused by his conscience and by making it unstable, To separate the validity from it, at this time, one should refer to the relevant practical principle according to the inferred topic.
