Assessing the Feasibility of Referring Compliance-Based Emulation in Acting (Tazāḥum) to the Conflict of Proofs

Abstract

In order to address the problem of conflicting evidence, scholars of Uṣūl al-Fiqh have developed two distinct areas of discussion. According to the prevailing view, conflict (taʿāruż) concerns incompatibility at the stage of enactment of the ruling, while Emulation in Acting concerns incompatibility at the stage of compliance (imtithāl). In their view, the boundaries and limits of the discussions raised under these two headings are completely separate from one another. However, it appears that that the discussion of Emulation in Acting ultimately returns to that of conflict. That is, even in cases of Emulation in Acting, the incompatibility originates at the stage of legal enactment and subsequently extends to the stage of compliance. It should be noted that some have regarded this discussion as contingent upon the discussion of the disaggregation of the address (inḥelāl-i khiṭāb) at the level of enactment or compliance. This article uses a descriptive-analytical method and seeks to explain how the aforementioned premise affects the issue under investigation and critically evaluates it. Ultimately, to establish its claim, the article critiques the differences mentioned between conflict (taʿāruż) and Emulation in Acting.
