Rational and Analytical Approaches of Muhaqqiq Iraqi in Usul al-Fiqh

Abstract

Rational and analytical approaches hold significance in Usul al-Fiqh from three perspectives: first, because certain Usuli issues are sometimes grounded in specific theological foundations; second, due to the inherently rational and analytical nature of some Usuli discussions; and third, for uncovering the harmony or tension between rational-analytical and interpretive (istidhhāri) approaches in particular cases. The central question is: how did Muhaqqiq Iraqi come to be distinguished by such an approach?



By examining Muhaqqiq Iraqi’s Usuli legacy, this distinction can be demonstrated in two domains. The first lies in his formulation of theological foundations for Usuli discussions—for example, the principle of the obligation to show gratitude to the benefactor and its connection to the principle of istiṣḥāb (presumption of continuity), the validity of conjecture (ẓann), and the obligation of compliance in cases of summary knowledge (‘ilm ijmālī); the principle of avoiding potential harm and its relation to the principle of the repugnance of punishment without prior clarification; his interpretation of iʿtibāriyyāt (constructs), which relates to the interpretation of designation (waḍʿ) and legal rulings (ḥukm); and his proposal of a third category of propositions, termed the "natural proposition" (qaḍiyya ṭabīʿiyya).
