Construction status and building a structure on graves in comparative jurisprudence

Abstract

The state of construction on graves which has been expressed in jurisprudence with different interpretations is disputed. Generally, Shias and Sunnis consider this action, inappropriate except for prophets, imams and good people of society. But the writers by accepting this exception, believe that the reasons for this issue are flawed, even the famous opinions of Shias and Sunni scholars, but what is certain, firstly, none of the Shia and Sunni scholars have absolutely ruled that this work is sacred, especially Shia, and what has been attributed to Shahid Sani is also incorrect, Unless there are unintended consequences regarding the burial place or construction tools and method, which is haram according to the case but it has nothing to do with the principle of the ruling and this is considered a separate judicial issue. Secondly, Today, it is customary among Muslim people and even non-Muslims to place a stone on the grave and engrave the name and even the picture of the dead on it, is for the purpose of preserving the name and memory of the deceased and preventing the graves from diggers access and animals on the corpse and destruction of the grave and nothing else.
