Analyzing the evidences of enjoining what is good and forbidding what is evil in relation to physical contact with a critical approach to Article 4 of the law on protection of those who enjoin what is good and forbid what is evil.

Abstract

One of the progressive rules of Islam, which God Almighty has invited the believers to in the Holy Quran, is the duty of enjoining good and forbidding evil. This duty has levels, one of which is manual level. There is a difference of opinion among the jurists regarding the inclusion of this rank in terms of enjoining good and forbidding evil. Famous jurists believe in inclusiveness. According to this matter, the law of protection of commanding good and forbidding evil by clarifying that commanding good and forbidding evil has heart, language, writing and manual levels, has removed the manual level from the responsibility of the people and introduced only the duty of the government. The present research, while examining the famous sayings and their evidences and the documents of non-famous sayings, proves that the order of the hand is not included in the order of enjoining good and forbidding evil. Considering this, the result of this research indicates that Article 4 of the Law on Protection of the Righteous and the Prohibited of the Unrighteous can be violated in terms of non-compliance with the Shariah and requires an additional provision on the shoulders of the government, so it is up to the guardians to make efforts to amend this article of the law.
